Welcome to ChatGuard. These Terms of Service ("Terms") govern your use of our mobile application and website (collectively, the "Service") operated by ChatGuard LLC ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

2. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

3. Account Terms

You are responsible for maintaining the security of your account and password. We cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. You are responsible for all activity that occurs under your account.

4. Subscription and Payments

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring basis, depending on the type of Subscription plan you select. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

You may cancel your Subscription at any time through your account settings or by contacting our customer support team. If you cancel, your Subscription will remain active until the end of the current billing period.

All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you will be responsible for payment of all such taxes, levies, or duties.

5. Free Trial

We may, at our sole discretion, offer a Subscription with a free trial for a limited period of time. You may be required to enter your billing information to sign up for the free trial. If you do not cancel the Subscription before the free trial period is over, we will automatically charge the payment method you provided for the Subscription fee.

6. Refunds

Except when required by law, payments are non-refundable. No refunds or credits will be provided for partial months of service, downgrade refunds, or refunds for months unused with an open account.

7. Acceptable Use

You agree not to misuse the Service. Examples of misuse include:

• Using the Service for any illegal purpose or in violation of any local, state, national, or international law
• Violating the rights of others, including privacy or intellectual property rights
• Attempting to breach or bypass any security measures
• Interfering with the proper functioning of the Service
• Utilizing our technology for monitoring adults without their consent
• Sharing your account or access credentials with others

8. Limitation of Liability

In no event shall ChatGuard, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

9. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance. ChatGuard does not warrant that the Service will function uninterrupted, secure or available at any particular time or location.

10. Governing Law

These Terms shall be governed by and defined following the laws of [Your Country/State]. ChatGuard and yourself irrevocably consent that the courts of [Your Country/State] shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these Terms.
